Paying Terminated Employees in Montana

In Montana, unpaid wages of terminated employees are due and payable within three days, except for state and local government employees; where the payroll checks originate from out of state, three additional days are allowed. If an employee is discharged for cause, all unpaid wages are due and payable immediately upon separation.

An employer may seek an order to stay the payment of unpaid wages due an employee who is terminated because of theft of the employer's funds or property where criminal charges have been filed against the employee. If the employee pleads or is found guilty, any wages due may be offset against the amount the employee illegally obtained from the employer.
