Private land use restrictionsA private land use restriction is a restriction that a land owner places on the use of property by its owner. If all legal requirements have been met (such as, the restriction has been properly recorded and does not violate public policy), the restriction will bind the property owner, plus all later buyers of the property. Common examples of land use restrictions are covenants by deed not to use the property for business purposes, and condominium restrictions forbidding certain property uses. Unlike the process of obtaining a variance from a zoning rule, a court proceeding may be required to lift a private land use restriction. |
